What this domain covers

Policy instruments live or die on their statutory text. Research in this domain produces legislative discussion drafts and the analysis behind them: which authority a measure rests on, which branch controls it, how it would fare under judicial review and in international fora, and which drafting choices close or open the exposure. Each draft is published with the reasoning that shaped it, so staff can evaluate the choices rather than take them on assertion.

  • Which branch controls the decision, and what procedure does the statute require?
  • How would the strongest challenge be stated, and what is the probable outcome?
